      <title>BROKERAGE COMMISSION: AN OVERVIEW</title>
      <description>A shipbroker ordinarily is not a party to the charter he procures. He is, though, usually entitled to enforce a charterparty brokerage clause in his own name pursuant to the Contracts (Rights of Third Parties) Act 1999 (the &apos;Act&apos;). The Act creates an exception to the doctrine of privity of contract. It enables a third party to enforce a contractual term if the contract expressly provides that the person may do so (section 1(1)(a)) or, of more relevance to a shipbroker, if the contractual term purports to confer a benefit on the person (section 1(1)(b)).
